Este manual es la primera guía exhaustiva de Derecho Europeo en materia de derechos del niño

Es una nueva
guía práctica de la Agencia de los Derechos Fundamentales de la Unión
Europea (FRA) y el Consejo de Europa.
En el Día Universal del Niño, la FRA,
el Consejo de Europa y el Tribunal Europeo de Derechos Humanos (TEDH)
lanzaron el Handbook on European law relating to the rights of the child
[Manual de Derecho Europeo relativo a los derechos del niño].
Este
manual es la primera guía exhaustiva de Derecho Europeo en materia de
derechos del niño, que toma en cuenta tanto la jurisprudencia del TEDH
como del Tribunal de Justicia de la Unión Europea.
Proporciona
información sobre la Carta de los Derechos Fundamentales de la Unión
Europea y los Reglamentos y Directivas pertinentes; la Carta Social
Europea; las decisiones del Comité Europeo de Derechos Sociales; otros
instrumentos del Consejo de Europa; así como sobre la Convención sobre
los Derechos del Niño y otros instrumentos internacionales.
Este manual
está diseñado para apoyar a los abogados, jueces, agentes de procuración
de justicia, trabajadores sociales, organizaciones no gubernamentales y
otros organismos con temas jurídicos relativos a los derechos del niño.
Aborda cuestiones como la igualdad, la identidad personal, la vida
familiar, el acogimiento alternativo y la adopción, la migración y el
asilo, la protección de los niños en contra de la violencia y
explotación, así como los derechos de los niños en los procedimientos de
justicia penal y alternativos.
Según Snežana Samardžić-Marković,
Directora General del Consejo de Europa, “una legislación y políticas
que promueven los derechos del niño tendrían poco impacto si no son
directamente puestas en práctica mediante la jurisprudencia nacional e
internacional. Los profesionales que trabajan con y para los niños deben
contar con un panorama completo y, aún más importante, con
conocimientos de los casos desarrollados por los tribunales
internacionales y regionales en este ámbito. Este manual será una
herramienta valiosa para hacer que los derechos de los niños sean una
realidad en sus vidas diarias”

Council of Europe Director General for Democracy Snežana Samardžić-Marković says: “Legislation

without them being directly implemented through national and

the case law developed by the international and regional courts in this
area. This handbook will be a precious tool to making children’s rights a
reality in their daily lives.”
The Handbook on European law relating to the rights of the child
is the first comprehensive guide to European law in the area of child
rights, taking into account both the case law of the ECtHR and the Court
of Justice of the European Union (CJEU). It provides information on:
the Charter of Fundamental Rights of the EU and relevant Regulations and
Directives; the European Social Charter (ESC); decisions of the
European Committee of Social Rights; other Council of Europe
instruments; as well as on the United Nations Convention on the Rights
of the Child (CRC) and other international instruments.
This handbook is designed to assist lawyers, judges, prosecutors,
social workers, non-governmental organisations and other bodies
confronted with legal issues relating to rights of the child. The
publication covers issues such as equality, personal identity, family
life, alternative care and adoption, migration and asylum, child
protection against violence and exploitation, as well as children’s
rights within criminal justice and alternative proceedings.
The handbook is available in English and French. Other language versions will follow in 2016.
The launch of the handbook is part of the annual World Forum for Democracy (link is external), organised by the Council of Europe in Strasbourg.
